A Win For Gun Rights: House Strikes Down Pistol Brace Rule

On June 13th, 2023, the House of Representatives passed a resolution of disapproval under the Congressional Review Act to block the Biden Pistol Brace Rule. The final vote was 219-210, with two Democrats joining the Republicans in the effort.

After months of fighting for the Second Amendment, @Rep_Clyde's bill — H.J. Res 44 — has PASSED out of the U.S. House and is headed to the U.S. Senate.

H.J. Res 44 now heads to the Senate for a vote. Due to the nature of this particular resolution, it is not subject to filibuster and, therefore, could likely pass the Senate in a very timely manner.

Of course, many of you smart readers know that once the resolution passes through the Senate, it lands on the President’s desk.

You might be saying to yourself: “Joe Biden will never sign that.” And you’d be correct.

In fact, the President has already made an official statement about his plan to veto the resolution if it reaches the resolute desk.

So why is this a win for gun rights? Because an act of Congress makes it clear that Biden’s Pistol Brace Rule is government by executive fiat.

To create the Pistol Brace Rule, Biden used his “regulatory authority,” aka an executive order, directing the ATF to ban pistol braces. The ATF then made a rule that classified pistol-braced firearms as SBRs or Short Barrel Rifles, subjecting them to taxation and registration via the NFA.

The rule took effect June 1st, and it is estimated that up to 40 million pistols are outlawed by the change.

Keep in mind ATF is a federal agency. It’s part of the Department of Justice and, therefore, part of the executive branch. The executive branch does not have the power to make law.

But the Biden administration feels that the separation of powers are just barriers to taking away your 2nd Amendment right. So, they’ve ignored the rule of law and used administrative rulemaking to pass “regulations,” subverting the system and effectively creating new laws for ATF to enforce.
If Congress puts the resolution on the President’s desk and he vetoes it, it’s evident that the executive branch needs to be checked and balanced. It then falls to the courts.

That’s a good thing for firearms activists. Federal courts have granted preliminary injunctions to the lawsuits focused on the Pistol Brace Rule, like our case GOA & Texas v. ATF. This act of Congress completely disproves ATF’s argument that they’re simply enforcing the will of Congress by regulating pistol brace equipped firearms, using the almost 100-year-old 1934 National Firearms Act as proof.

This resolution sends a strong message to the courts that ATF is wrongfully assuming Congress’s intent.

Courts would have no choice but to refute ATF’s argument and strike down the Pistol Brace Rule permanently.

Gun Owners of America has been working diligently with our allies in Congress to make sure H.J. Res. 44 passed. We’re excited to celebrate victory with our members and supporters.

We applaud the House for doing their part to block this rule and to send a message to the Administration and Courts that the ATF went well beyond its statutory authority with this rule. > Many of these representatives deserve praise, but especially Congressman Clyde for championing the issue, and the House Democrats who joined their Republican colleagues in voting to block this rogue administration from making their constituents felons.

Now we turn our attention to the Senate, where a discharge petition has already been filed and this resolution can be fast-tracked to the floor without the ability for anti-gunners to filibuster. We urge Senate Democrats to join Republicans in blocking this rule, and we will do everything in our power to ensure this resolution passes as soon as possible.

But the fight is not over yet. While the resolution only needs a simple majority of 51 votes, many weak Republican Senators will be pressured not to vote yes. We’re calling on all gun owners, especially those in Maine, Arizona, Montana, West Viriginia, Alaska, and other states with potential key votes to make their voices heard by letting their Senators know to vote to overturn the Pistol Brace Rule.

Illinois begins arming non-citizens while disarming citizens

Citizens may bear arms 'subject to police power'

Illinois Governor J.B. Pritzker Friday signed into law a bill that allows non-citizens to become police officers after instituting heavy gun restrictions for civilian citizens.

According to HB3751, a non-citizen who has a valid work permit is eligible to become a police officer, including those who entered the country illegally as children and have still not obtained citizenship. Other criteria required for eligibility are the same as those for citizens, including the applicant being able to obtain, carry, purchase, or otherwise possess a firearm under federal law.

Law enforcement officers are exempt from many gun restrictions which apply to civilian citizens, including a law signed by Governor Pritzker in January which bans the possession of assault rifles. Civilians are also now prohibited from selling or possessing more than 15 rounds of ammunition in most places. Police officers, including non-citizens, are permitted to carry assault rifles on duty and are issued more ammunition.

Concealed carry laws are also restrictive in Illinois. Civilian citizens who wish to carry a concealed firearm must go through a rigorous application process to obtain a permit, which is reviewed by the Illinois State Police. The police can object to granting any civilian a concealed carry permit "based upon a reasonable suspicion that the applicant is a danger to himself or herself or others, or a threat to public safety". The objection is then considered by a Concealed Carry Licensing Review Board, which decides whether or not to grant the permit.

Non-citizen law enforcement officers, however, even if retired, are exempt from local and state concealed carry laws. In addition to carrying state-issued firearms concealed while off-duty, they are also permitted to carry personally owned firearms as secondary weapons:

The Department may authorize officers to carry a personally-owned firearm as a secondary weapon for on-duty, off-duty, supplemental, covert, or other approved specialty purposes.

Law enforcement officers, including non-citizens, can also seize a civilian’s firearm during a traffic stop or in any situation where “the law enforcement officer or emergency services personnel determines that it is necessary for the safety of any person present, including the law enforcement officer or emergency services personnel.” If and when the police officer determines that the civilian is no longer a threat and is “mentally capable of possessing the firearm,” the firearm is returned. If the civilian is transported to another location for “treatment,” the firearm must be turned over to any police officer.

"Subject only to the police power, the right of the individual citizen to keep and bear arms shall not be infringed,” states the Illinois Constitution.

A burglar made a big mistake by challenging an armed homeowner to try and kill him during a home invasion.

The Georgia homeowner confronted the crook in the basement of his property on Thursday, Fayette County Sheriff Barry Babb told WAGA-TV.

Before coming face-to-face with the unwelcome thug, the homeowner had called the police to report an intruder.

The home’s alarm system was also alerting the police about a break-in.

Babb says that the homeowner confronted the intruder in the basement and gave him a warning.

When the criminal refused to back down, the homeowner fired one gunshot and struck the intruder.

The homeowner then took up a position at the top of his staircase on the second story of the home while he waited for police to arrive.

Babb said that the suspect started going up the stairs to attack the homeowner.

The thug then yelled out the homeowner, warning him: “You’re gonna have to kill me.”

As the robber continued to approach, the homeowner was left with no choice but to shoot him a second time.

Deputies arrived just after the second shot was fired.

Sheriff Babb said they struggled with the intruder as they tried to take him into custody.

The suspect was then transported to a local hospital.

We live in a media-driven culture. We also have government agencies putting out biased reports that serve their political masters. And it’s rare that the media even question those agencies’ reports.

That wouldn’t matter, but many of us tend to confuse media headlines with facts. I’ve seen people on Facebook say that there were hundreds of “mass shootings” this year and that our children aren’t safe in school any longer. They’re wrong, and armed individuals stop mass murderers most of the time.

That raises a question: If an ordinary citizen stops mass murder and the mainstream media refuses to report it, did it really happen?
