Supreme Court overturns New York law on carrying concealed weapons

> The Supreme Court has struck down New York’s century-old law restricting the carrying of concealed firearms, its first major Second Amendment decision in more than a decade and a ruling that could lead to more guns on the streets.

Writing for the 6-3 majority, Justice Clarence Thomas said Thursday that the law’s requirement of New Yorkers who want a permit to carry a handgun in public to show “proper cause” that the weapon is specifically needed for self-defense “violates the Fourteenth Amendment by preventing law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms in public.”

Though the decision concerns New York law, it is likely to affect a handful of other states with similar permitting regimes, including California, Hawaii, Maryland, Massachusetts, New Jersey and Rhode Island.

In a separate opinion concurring with Thomas, Justice Brett Kavanaugh and Chief Justice John Roberts wrote that Thursday’s ruling does not preclude state and local restrictions on gun ownership by felons and the mentally ill — or laws banning the carrying of firearms in “sensitive locations” like schools and government buildings.

The Supreme Court issued a ruling striking down New York’s concealed carry law. The decision, released Thursday, had six justices stating it violates the Second Amendment while three dissented. In the majority opinion, Justice Clarence Thomas wrote the state’s licensure laws are unconstitutional.

New York banned the issuance of concealed carry permits unless there is a demonstrable need for self defense, allowing the state to reject most permits. The court has now upheld the right of every American to self defense both on their own property and in public.

The US has passed its first major gun safety law in decades in the wake of several high-profile shootings

The US House on Friday passed a package of gun control measures, including stepped-up background check requirements for younger buyers and funding for mental health programs. Already passed by the Senate on Thursday, the legislation heads to President Joe Biden’s desk, where it is expected to be signed.

Biden described the Bipartisan Safer Communities Act as “one of the most significant steps Congress has taken to reduce gun violence in decades” in a statement released on Thursday.

Under the new law, individuals 16 years or older attempting to purchase a gun must undergo a review of their juvenile mental health records. It also closes the so-called “boyfriend loophole,” barring anyone convicted of a domestic violence misdemeanor as part of a dating relationship from purchasing or owning a firearm for at least five years.

The legislation also provides funding for “extreme risk protection order programs” and other crisis intervention measures, supplying $250 million in community violence intervention and prevention initiatives and $100 million to beef up the National Criminal Instant Background Check System. This includes so-called “red flag” laws permitting authorities to confiscate guns from people deemed a threat to themselves or others.

The law also requires individuals who “repeatedly buy and sell firearms” to register for a federal firearms license and perform background checks on their clients. The criminal penalties for “straw” purchases, in which one individual buys a gun on behalf of someone who does not want their name associated with the transaction – whether because they are legally barred from owning a gun or for privacy reasons – are also increased under the new legislation.

Additionally, the bill expands community behavioral health clinics and telehealth services, in particular mental health services in schools, supplying $250 million for Community Mental Health Services block grants. The grants help train primary care providers and school and childcare professionals in mental health care as well as providing treatment for individuals who have experienced trauma. A $1 billion grant is aimed at funding “after-school, before-school and summer programs,” with $300 million going toward training students and teachers in “how to prevent and respond to violence against themselves and others.”

Democratic lawmakers have clamored for stricter gun control laws in recent weeks following a string of widely-publicized shootings, including the slaying of 19 children and two adults at Robb Elementary School in Uvalde, Texas.

In the House, the bill was passed unanimously by Democrats, with 14 Republicans also joining to support it in a 234-to-193 vote. The Senate saw it pass 65-to-33, with 15 Republicans joining all of the Democrats.

Senators teased the legislation with a “framework” released earlier this month before releasing the text of the bill on Tuesday. While the bill does not go as far as Democratic congressional leaders have called for with regard to strengthening background checks and doing away with high-capacity magazines, the party’s razor-thin Senate majority and the need to overcome the 60-vote filibuster threshold to push legislation through restrained some of their more radical impulses.

Nevertheless, the National Rifle Organization slammed the bill earlier this week as unacceptable, arguing the measures therein could be “abused to restrict lawful gun purchases, infringe upon the rights of law-abiding Americans, and use federal dollars to fund gun control measures being adopted by state and local politicians.”

The lobbying group’s influence is frequently blamed for the lack of legislative action in the aftermath of mass shootings.

Here is another article that goes into more detail:

Congress sends landmark gun violence compromise to Biden

America is suffering a deep-seated partisan divide.

The House sent President Joe Biden the most wide-ranging gun violence bill Congress has passed in decades on Friday, a measured compromise that at once illustrates progress on the long-intractable issue and the deep-seated partisan divide that persists.

God's Law is the Supreme Law of the Land. I have The Bible to prove it. There are instances where the Constitution and The Law of God intersect.

Evangelist Torben Søndergaard Came to US for Asylum, Now He's Been Arrested, Accused of Gun Smuggling

Torben Søndergaard, a Danish evangelist and founder of a ministry called The Last Reformation, says he is being held by Immigration and Customs Enforcement (ICE) for suspicion of "smuggling weapons from Mexico to America."

The 45-year-old Søndergaard says he is being held in isolation at ICE's Baker County Detention Center, a medium-security detention center located in MacClenny, Florida.

On his Facebook page, Torben writes, "This Thursday, I was invited to a meeting with Homeland Security who wanted to talk about my asylum case - a case where I, in Denmark three years ago, was accused of doing many things I had not done, and where I ended up fleeing to America seeking asylum. But then, they suddenly said that the real reason I was there was because they had been notified that I was smuggling weapons from Mexico to America, and I was in shock."

Woman Shoots Gunman Dead After He Begins Firing Rifle at Graduation Party, Detective Says She Saved ‘Several Lives’

A woman fatally shot a gunman who fired a rifle at dozens of graduation party attendees last week, according to police. The incident occurred in Charleston, West Virginia.

According to investigators, a man named Dennis Butler was warned about speeding near the Vista View Apartment complex with children present.

Butler returned with an AR-15-style rifle and began firing into the crowd, WCHS-TV reported.

A bystander attending the party acted quickly by pulling out her handgun and shooting Butler. 37-year-old Butler received multiple gunshot wounds and was pronounced dead.

Butler had an extensive criminal history.

Officers arriving at the scene around 10:45 p.m. and there were no reports of injuries to those attending the party.

Several witnesses, including the woman who fired the gun, waited for police to arrive and fully cooperated with the investigation.

Chief detective Tony Hazelett confirmed that no charges will be filed against the woman who took out the gunman.

“Instead of running from the threat, she engaged with the threat and saved several lives last night,” Hazelett said.

He added that she was “lawfully carrying” her gun and “we could have had a casualty shooting” if it weren’t for her actions.

The Way home or face The Fire

12:98 No criminal is really afraid of human police, who can not be everywhere at once, or on the
spot, and who do not have the help of the public, because they have alienated them. If criminals were
afraid of the police, they would not be criminals.
12:99 Guns were originally invented for hunting food, and for protection, against wild-animals, and
also for self-defence against evil aggression, because a small, or old person, could not defend
himself/herself against a stronger aggressor. Guns are an equalizer.
12:100 NO-ONE has the right, to take away the rights that God gave to YOU; one of which is your
right to self-defence, against evil, and aggression (real and NOT imaginary); unless they can replace it with something better.
12:101 The police, because of their own cowardice, have made it illegal to own a gun, and to defend yourself, and have given you nothing in return, because they can not possibly be with you, all of the time, and they are so busy chasing honest people, for money, that they do not have the time to protect the public from, and to catch, REAL criminals.
12:102 Prevention is always better than cure, and a young thug would think twice, about attacking an old lady, or gentleman, if that old person possibly had a gun, and could shoot them, LAWFULLY,
in accordance with GOD’S Laws (Exodus 22:2).
12:103 Given a perfect situation, in a society, if you were to disarm anyone, you would disarm the
criminals; wouldn’t you? So what does man do, with his stupid illogic? He decides to disarm The
Law-abiding public, who are no danger to anyone, and leave violent and vicious criminals with
weapons, and then, to make the situation even worse, he does away with the only other deterrent to
criminals - “the DEATH-Penalty”.
12:104 The harmless, Law-abiding public, are then left, totally defenceless, against armed, vicious
criminals, whilst the police are busy STEALING money from motorists, under unlawful human
laws/legislation.
Do you think THAT makes SENSE? - Totally insane!!!
12:105 YOU voted for these lunatics, and their insane, unlawful laws/legislation (human
government-policies: enforced by police), so you are now suffering all this violence and crime -
Divine Justice (Isaiah 3:12-15).
12:106 It is now illegal to defend yourself, your family, or the weak, and, the way it is going, it will
soon be illegal to be a man.
12:107 The police say that, “We cannot have the public taking The (its) Law into its own hands.”
The Law belongs to the PUBLIC, not to the police and should never have been taken out of the
public’s hands.
12:108 The police’s job is only to ensure that the public; in executing ITS Laws; do not exceed, or
break those Laws themselves, and to help the public, both to investigate crimes, and maintain Law
and order.
12:109 Unfortunately, they no longer act as public servants, but as human government-licensed
thieves, and a law unto themselves. Instead of the public telling the police what to do, the police now “dictate” to the public. The police (policy-enforcers, NOT Law-enforcers) have become a big stick,
that the rich use, to beat the poor.
12:110 You all have a voice and a vote, and can change the laws, to be for your benefit, NOT the
benefit of the criminals. Man’s unlawful and unjust laws/legislation punish the innocent, whereas
God’s Laws punish the guilty. Legal-precedents MUST be abolished, and EVERY case heard on its
own merits, with other cases used ONLY as a guide (if necessary), NOT as a pre-set rule, so that
JUSTICE will be done, instead of injustice in the name of precedents (Amos 5:7, 10, 24 & 6:12 &
Habakkuk 1:4).
