A court in La Línea has launched preliminary investigations into the passport controls for individuals entering the country from Gibraltar.
This follows a complaint by a Policia Nacional Chief Inspector stationed at the border post, who has alleged misconduct and coercion by his superiors.
The complaint suggests that thousands of Gibraltarians cross into Spain daily without presenting a passport, a breach of the Schengen Borders Code.
The complaining Chief Inspector says this is an informal practice, verbally authorised to ease border flow, and has been in place since before Brexit.
He says the the selective enforcement of border controls is “unsustainable,” citing potential risks to safety and compliance.
Gibraltar left the European Union in January 2020, but unlike the rest of the UK, it did so without a deal in place.
Since then, temporary bridging measures have been in place, with Spain allowing Gibraltarians to cross without having their passports stamped.
