South Africa files case at ICJ over Israel's 'genocidal acts' in Gaza

The UN’s top court, which settles disputes between states, said on Wednesday that it would hand down its landmark ruling on Friday. The Hague-based body could order Israel to stop its three-month campaign in the Gaza Strip, sparked by the unprecedented attack by Hamas on 7 October. ICJ rulings are binding and cannot be appealed against, although the court has no power to enforce them. ICJ INTERIM RULING ON GENOCIDE CASE AGAINST ISRAEL

The complete list of orders from the International Court of Justice (ICJ) to Israel regarding the South African genocide case against Israel.
The International Court of Justice rules by overwhelming majority:

  • Israel must halt attacks on Palestinians
  • Ensure humanitarian aid
  • Preserve evidence

The only judge that opposed all measures was Judge Sebutinde (Uganda). The only other Judge to join her in opposition on these measures (see below) was Judge Barack (Israel).

A panel of 17 judges on the International Court of Justice (ICJ) dismissed Israel's bid to throw out the case and ordered it to report back in a month, also outlining six provisional measures to protect Palestinians in Gaza.

In its interim order, the court ruled:

· Israel must take all measures within its power to prevent the act of genocide (15 votes to two)

· Israel must ensure the military does not commit acts of genocide (15 votes to two)

· Israel must take all measures within its power to prevent or punish incitement of genocide (16 votes to one)

· Israel must ensure humanitarian assistance to Gaza (15 votes to one)

· Israel must prevent the destruction of allegations of acts of genocide (15 votes to two)

· Israel shall report to the court within one month (15 votes to two)

ICJ ruling: Arab ambassadors discuss the verdict

"All eyes turn now to the security council. It seems likely by the middle of next week, the council will call for an open meeting to discuss the rulings by the ICJ. Then, the question becomes, 'will Algeria, the Arab member of the council, begin to circulate a draft resolution calling for an immediate ceasefire'? Diplomatic sources are telling us all indications are pointing to exactly that."

The UN Security Council is due to meet on Wednesday to discuss the ICJ ruling. It follows a request from Algeria after a closed-door meeting of ambassadors from Arab nations. The UN Secretary General reaffirmed his call for a ceasefire.

The meeting, called by Palestine in coordination with Egypt and Jordan, will formulate a unified Arab stance in response to the recent measures issued by the ICJ against the Israeli regime.

“The meeting aims to take comprehensive measures to prevent prohibited acts under the Genocide Convention, ensure the immediate provision of urgent humanitarian needs for the Gaza Strip, and hold Israel accountable for incitement to genocide in Gaza,” it said in a statement.

There is zero evidence that counterfeit-Israel will comply with any of the rulings put forth by the ICJ 4 days ago (26Jan2024). The genocide continues with full support by the US and its allies.

The ICJ gave Israel one month to show that it has taken measures to protect the Palestinians. If Israel either fails to respond or does not respond satisfactorily, then the ICJ will send its order to the UN Security Council (UNSC) for enforcement. The UNSC will be bound by the UN Charter to enforce the order.

Israel has already rejected the order. That means that the order will be sent, a month from now, to the UNSC.

How will the three veto-power Global North countries (France, the United Kingdom, and the United States) react to the order?

Alongside the ICJ order, Judge Xue Hanqin wrote a separate opinion... Judge Xue raised the issue of erga omnes (“towards all”), which implies that this is a case where Israel’s actions harm the world community and Israel must be impelled to stop its war on behalf of all of humanity. “For a protected group such as the Palestinian people,” Judge Xue wrote, “it is least controversial that the international community has a common interest in its protection.”

While the order itself did not directly call for a cessation of hostilities, Judge Bhandari did so. “All participants in the conflict,” he wrote, “must ensure that all fighting and hostilities come to an immediate halt and that remaining hostages captured on 7 October 2023 are unconditionally released forthwith.”

Twenty years ago, the ICJ studied the building of a wall around the West Bank in the Occupied Palestinian Territory (OPT). In July 2004, the ICJ found that “the construction of the wall by Israel… is contrary to international law.” There has been a relentless battle over the jurisdiction of the ICJ to rule over Israel’s behavior in the OPT, including in 2022 when a legal opinion was sought by several states over the finding of a UN Human Rights Council commission of inquiry chaired by the South African judge Navi Pillay. Pillay’s report found “reasonable grounds to conclude that the Israeli occupation of Palestinian territory is now unlawful under international law due to its permanence and the Israeli government’s de-facto annexation policies.” Israel contested the ICJ’s jurisdiction in the case. Now, with this charge of genocide, the court established its jurisdiction and Israel accepted it by participating in the proceedings.

The ICJ ruling and the aftermath for Palestine

There have been mixed reactions with widescale approval from many Western analysts and disappointment and anger from Palestinians and regional analysts. I will try to unpack both sides.

IMHO, the ICJ (and ICC) are gatekeepers like the gov'ts witnessed globally with some being better than others, but all ultimately criminal organizations practicing treason against God and His people. When a crime is witnessed, particularly a lethal one, it is not right to ponder and look upon the act whilst discussing, then making judgements as to what to do. No! One does whatever needs to be done at once. Then an assessment can commence. I agree with the Gazan journalist, in that there is no justice globally and we know (at least here on DF) why; the lack of applying The Laws of God.
